These Terms of Use ("Terms") govern your access to and use of the InTouch123 application and website (the "Service") operated by InTouch123 ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years of age to use the Service. By using InTouch123, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

2. Account Registration

To use InTouch123, you must sign in with your Google account. By doing so, you authorize us to access certain information from your Google account as described in our Privacy Policy. You are responsible for maintaining the security of your Google account credentials.

3. Description of Service

InTouch123 is a sales productivity tool that helps you prepare for meetings by:

• Accessing your Google Calendar (read-only) to identify upcoming meetings and attendees
• Looking up publicly available professional information about your meeting attendees from LinkedIn and other public sources
• Generating meeting preparation summaries about the people you are meeting with
• Sending you emails with meeting preparation information before your scheduled meetings

4. Google Account Permissions

By using the Service, you grant InTouch123 permission to:

• Access your Google profile information (name, email, profile picture)
• Access your Google Calendar in read-only mode to view your events and attendee information

You may revoke these permissions at any time through your Google Account permissions settings. Revoking permissions will prevent the Service from functioning fully.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
• Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems
• Use the Service to send spam, unsolicited communications, or harassing messages
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service in a way that could damage, disable, or impair its functionality
• Use automated means (bots, scrapers) to access the Service except as expressly permitted
• Resell, sublicense, or redistribute the Service or any data obtained through it

6. Emails and Communications

By using the Service, you consent to receive emails from InTouch123, including meeting preparation summaries and service-related notifications, sent to the email address associated with your Google account. You can stop receiving these emails by disconnecting your account or contacting us.

7. Third-Party Data and LinkedIn

InTouch123 looks up publicly available professional information about your meeting attendees from LinkedIn and other public sources. This information is provided for your convenience to help you prepare for meetings. We do not guarantee the accuracy, completeness, or timeliness of information obtained from third-party sources.

8. Intellectual Property

The Service, including its design, features, content, and underlying technology, is owned by InTouch123 and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. Information provided about meeting attendees is sourced from publicly available data and may not be accurate or up to date. You should independently verify any critical information.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INTOUCH123 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless InTouch123, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service at any time by revoking Google account permissions and contacting us to request account deletion.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on our website. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
